Welcome to magin8 (“the App”). By downloading, accessing, or using magin8, you agree to these Terms of Use. If you do not agree, please do not use the App. This agreement is between you and magin8 only.

1. Acknowledgment

You and magin8 acknowledge that app stores (Apple App Store and Google Play) are not responsible for the App, its content, or services, and Apple or Google do not provide maintenance or support. Any issues with the App are your responsibility to address with us.

2. Eligibility

You must be at least 4 years old (or the minimum age in your region) to create an account and use magin8. By using the App, you affirm that you meet this requirement.

3. License Grant

magin8 grants you a non-transferable license to use magin8 on any Apple- or Android-branded device you own or control. Family Sharing or volume purchasing may allow access by other accounts associated with the purchaser.

4. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate information when creating your account.
• All activity under your account is your responsibility.
• Accounts violating these Terms may be suspended or terminated.

5. User Content

5.1 Input Content

You retain ownership of all content you submit (voice prompts, text prompts, etc.).

5.2 Generated Images

Images are stored in the cloud and associated with your account until deletion. By using the App, you grant a limited license to magin8 for storage and processing to provide App functionality.

5.3 Prohibited Content

You may not generate:

• Illegal content
• Harassment, hate, or violent material
• Explicit or sexual content involving minors
• Deepfakes of real individuals without permission
• Content that infringes copyright or intellectual property rights

6. Acceptable Use

You agree not to:

• Misuse the App for fraudulent or unlawful purposes
• Reverse engineer or access underlying systems
• Use bots or automated tools
• Interfere with App security or functionality
• Bypass usage limits

Violations may result in account suspension or termination.

7. AI Limitations

magin8 uses AI to generate content, which may be inaccurate or incomplete. Do not rely on AI-generated content for medical, legal, financial, or safety-critical decisions.

8. Purchases & Subscriptions

magin8 is subscription-based and all features require a subscription to access:

• Payments are processed through the respective app store (Apple App Store or Google Play).
• Trial periods, billing, and refunds follow the store’s policies.
• Purchased features are linked to your account and available across devices.

9. Maintenance & Support

magin8 is solely responsible for maintenance and support. App stores are not obligated to provide support or updates.

10. Warranty

The App is provided “as is” without warranty. Any claims regarding product performance, accuracy, or compliance are the responsibility of magin8.

11. Limitation of Liability

To the maximum extent allowed by law, magin8 is responsible for:

• Any damages from use of the App
• Loss of data
• Unauthorized access to accounts or content

App stores are not liable for any direct, indirect, or consequential damages.

12. Product Claims & Legal Compliance

• You are responsible for any claims arising from use of the App.
• End-Users must not be in embargoed countries or on restricted lists.
• All intellectual property infringement claims must be handled by magin8.

13. Intellectual Property

• All App content, logos, software, and branding belong to magin8 or licensors.
• You may not copy, distribute, or create derivative works.

14. Third-Party Terms

• End-Users must comply with third-party agreements when using the App (e.g., VoIP usage).
• Third-party services (AI models, cloud, analytics) are subject to their own terms.

15. Termination

• Accounts may be suspended or terminated for violations or misuse.
• Users may delete accounts; associated cloud data will also be removed.

16. Updates

These Terms may be updated. Continued use constitutes acceptance of changes.
