Welcome to magin8 (“the App”). By downloading, accessing, or using magin8, you agree to these Terms of Use. If you do not agree, please do not use the App.

1. Overview

magin8 is a mobile application that allows users to generate images based on voice or text prompts using artificial intelligence (“AI”). These Terms govern your use of the App, including content generated within it and any accounts you create.

2. Eligibility

You must be at least 13 years old (or the minimum age in your region, such as 16 in the EU) to create an account and use magin8. By using the App, you affirm that you meet this requirement.

3. Your Account

To use magin8, you must create an account.

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and truthful information when creating your account.
• You are responsible for all activity performed under your account.
• You may manage, update, or delete your account at any time.
• We reserve the right to suspend or terminate accounts that violate these Terms.

By creating an account, you consent to the storage and processing of your account data in accordance with our Privacy Policy.

4. User Content

4.1 Input Content

This includes voice prompts, text prompts, and any data you submit to generate images. You retain rights to your input content.

4.2 Generated Images

• Generated images are stored securely in the cloud and are associated with your account.
• Images remain stored until you delete them.
• You may use generated images for personal, professional, or factual purposes, unless otherwise restricted.
• By using magin8, you grant us a limited license to store and process images for app functionality, including history, syncing, and generation.

4.3 Prohibited Content

You may not use magin8 to generate:

• Illegal content
• Harassment, hate, or violent material
• Explicit or sexual content involving minors
• Deepfakes of real individuals without permission
• Content that infringes copyright or intellectual property rights

We may remove content that violates these rules.

5. Acceptable Use

You agree not to:

• Misuse the App for fraudulent, harmful, or unlawful purposes
• Reverse engineer, modify, or attempt to access underlying systems
• Use automated tools, bots, or scraping
• Interfere with the App’s functionality or security
• Attempt to bypass usage limits or restrictions

We may suspend or terminate access for violations.

6. AI Limitations

magin8 uses AI to generate content. AI-generated output may be inaccurate, incomplete, or unexpected.

magin8 is provided for creative purposes, including professional or factual use.

Do not rely on AI-generated content for:

• Medical decisions
• Legal decisions
• Financial decisions
• Safety-critical purposes

7. Intellectual Property

• All App content, interfaces, logos, software, and branding are owned by [Your Company Name] or its licensors.
• You may not copy, distribute, or create derivative works from the App.

8. Purchases & Subscriptions

magin8 offers paid features, subscriptions, or in-app purchases:

• All payments are processed by the Apple App Store or Google Play.
• Billing, trial periods, and refunds follow the store’s policies, with the following additional conditions:
  • No refunds will be issued if the service or features associated with the billing period have been accessed or used.
  • Refund requests may be denied if there is evidence of service usage during the relevant period.
• We do not store your payment information.
• Purchased content and subscription features are associated with your account and are available across devices linked to your account.

By subscribing, you acknowledge that using the services constitutes acceptance of the billing period, and refund requests for periods where the service has been accessed may be denied.

9. Privacy

Your use of magin8 is governed by our Privacy Policy, which explains how we collect, use, and store your data.

10. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Misuse the App
• Engage in illegal or harmful activity

You may also stop using the App at any time by deleting your account or uninstalling the app. Deleting your account will remove associated cloud data, including images.

11. Disclaimer of Warranties

magin8 is provided “as is” and “as available”. We do not guarantee:

• Error-free operation
• Accuracy or suitability of AI-generated content
• Uninterrupted service

12. Limitation of Liability

To the fullest extent allowed by law, we are not liable for:

• Any damages from use of the App
• Loss of data
• Unauthorized access to your account or content
• Inaccurate or inappropriate AI-generated content
• Indirect, incidental, or consequential damages

Your sole remedy is to stop using the App.

13. Third-Party Services

magin8 may integrate with third-party services (AI models, cloud storage, analytics, or speech recognition). Their use is subject to their own terms and privacy policies. We are not responsible for third-party services or content.

14. Updates to Terms

We may update these Terms from time to time. The “Last Updated” date will reflect changes. Continued use of magin8 constitutes acceptance of the revised Terms.
